Gambling is an aspect embedded in human history. The prospects of limiting or preventing gambling from any society are bound to be faced by numerous challenges. Gambling manifests itself in many forms. While the efforts of governments to regulate this industry are unrelenting, Gambling keeps evolving with advances in technology. New means and ways of gambling keep emerging in efforts to circumvent the established regulatory measures. The establishment of laws governing gambling activities has not deterred gambling activities. The passing of the Wire Act in 1961 by Congress was aimed at preventing placing of bets through telephones. However, at this time the concept of internet gambling was not foreseen.
Therefore, a provision against internet gambling was not included since technological advances were not foreseen. The enactment of the Internet Gambling Prohibition Act of 1997 resulted from the use of the internet in gambling transactions (Hammer, 2001). This bill aimed at increasing the scope of the Wire Act by encompassing gambling via the internet. This act sought to function through the imposition of fines, imprisonment and absolute removal of an internet gambling site. However, as a result of failure to vote on the bill, Congress did not pass the Act which led to the Internet Gambling Act of 1999 and the Unlawful Internet Gambling Enforcement Act (Hammer, 2001).

Despite the implementation, of laws aimed at controlling and preventing gambling, the success rate of these laws is minimal. The Unlawful Internet Gambling Enforcement Act, as much as it aims at preventing online gambling, has no absolute control of all forms of cyberspace gambling. Though internet gambling may be limited to some extent, it is human nature to find another way to gamble undetected by the law and outside the application of the law.
